Operational framework

In Belgium it is necessary to separate citizenship, duration, competent region and work activity. For an Italian student, the residence process starts with registration with the municipality; for a third country student the reference is D visa and stay for study. This distinction also affects insurance, employment and renewal.

EU

Rule:Italians work without a single permit.

What to do:The contract and social security remain.

Extra-EU

Rule:The student residence card allows work within conditions; during the academic year the typical limit is 20 hours/week compatible with study.

Student@work

Rule:The subsidized quota is expressed in hours and changes by law; consult personal balance.

Student contract

Rule:Must be written with mandatory information and legal probationary period.

What to do:Sign by start.

Solidarity contribution

Rule:Within the quota, a reduced contribution applies, but rights and taxes remain to be verified.

Dimona

Rule:The employer declares hours before work.

Pay

Rule:Minimums depend on commission paritaire and CCT, age/sector.

What to do:Identify CP/PC.

Hours

Rule:Special rules protect students and minors.

Vacation

Rule:Student work and ordinary work can produce different rights.

Self-contained fake

Rule:Student-indépendant requires social security and conditions.

What to do:Do not use match for employment.

Exploitation

Rule:Social inspection and trade unions assist.

End of relationship

Rule:Ask for individual compte, tax form and final pay.

Personal payroll audit

Each pay cycle compares rosters, hours started/finished, breaks, classification, base rate, increases, allowances, deductions and net received. Record mandatory training, opening/closing and work requested out of shift separately. Don’t wait months: small repeated errors become difficult to reconstruct and some actions have short deadlines.

Keep evidence in a personal account, not just in the employer’s app. Download agreement, payslip and roster; Photograph timesheets if permitted and save messages about changes. Don’t bring customer data or company secrets: document your relationship without violating other people’s privacy.

Evaluate an offer

Before accepting, ask for the company’s legal name/number, location, duties, employment status, guaranteed hours, rate, pay cycle, proof, notice and responsible person. Compare travel costs and times with study and visa. A seemingly high contractor salary may be lower after tax, insurance, leave and non-billable time.

Refuse payments to obtain shifts, mandatory purchase of sponsorship, refund of cash and withheld documents. Do not sign blank sheets or fake timesheets. If housing and work depend on the same person, prepare an alternative plan: losing both increases the power of blackmail.

Proportionate escalation

For a simple error, send calculation and request with a reasonable deadline. For lack of salary, security, discrimination or migratory threat, immediately use the competent body, union, community legal service or student support. In an emergency, protect the person before the tests. Don’t accept a settlement or resignation without understanding waivers, taxes and visa consequences.

Three separate limits

Since 1 January 2025 the reduced-contribution student package is 650 hours per calendar year. Hours beyond it remain possible but attract ordinary social contributions. A non-EU student whose card says “labour market limited” is separately restricted to 20 hours a week during the academic year, compatible with study, and may work without that weekly cap during official school holidays. Remaining Student@work hours never override that immigration limit.

The employer must file Dimona before the work and provide a written student contract. Sectoral collective agreements set pay; where none applies, from 1 July 2026 the interprofessional reference at age 21 is €2,233.61 monthly or an indicative €13.5644 hourly on 38 hours, with age percentages below 21.
