Operational framework

In Ireland, citizenship, duration and form of the course determine different procedures. For an Italian the starting point is the EU right of free movement, without visa or ordinary immigration registration for the Italian citizen; for a non-EU student it is the entry visa when required, suitable course and registration of the permission at Immigration Service Delivery. The following sections separate the paths and indicate which evidence to keep.

EU citizens

Rule:An Italian can work without an employment permit, but the contract, Revenue, PPSN and minimum rights remain separate from the right of residence.

What to do:Complete tax registration and do not accept undeclared cash work.

Stamp 2

Rule:Stamp 2 allows casual employment of up to twenty hours per week in term-time and forty in officially admitted periods; Stamp 2A does not allow work.

What to do:Check your ISD printout and calendar, log all hours, and don’t use the monthly average to exceed your weekly limit.

Operational verification:Before closing «Stamp 2», verify the identity of the institution or counterparty, complete document, competent territory and receipt. Don’t rely on a verbal response.

Contract and statement

Rule:The employer must provide essential information and written conditions within the established deadlines.

What to do:Keep statements, job descriptions, rosters and any changes in pay or location.

Operational verification:Enter «Contract and statement» in the transfer calendar with initial event, deadline, variable cost and alternative plan if the document is rejected or delayed.

Minimum pay

Rule:National Minimum Wage, youth rates and possible sectoral orders change over time.

What to do:Check current WRC rate and compare actual hours, payslip and credit.

Operational verification:Review “Minimum Pay” when they change address, course, duration, job or insurance; retains the version of the official page consulted.

Time and breaks

Rule:Working time, rest, breaks and Sunday premium are regulated; student employment does not lose these protections.

What to do:Keep an independent log of clock ins, clock outs, breaks and canceled shifts.

Tax and emergency tax

Rule:Without PPSN or correct job registration on myAccount, emergency tax may be applied.

What to do:Register your first job, check Tax Credit Certificate and request reimbursement through Revenue, not the employer in cash.

Security and discrimination

Rule:The employer must manage risks and cannot discriminate on protected grounds.

What to do:Report incidents, maintain messages and use WRC, HSA or union support as appropriate.

End of relationship

Rule:Notice, final pay, accrued holidays and remedies for dismissal depend on seniority and facts.

What to do:Don’t sign a waiver without understanding it; act soon as WRC terms can be short.

Exact student-work and pay rules for 2026

Stamp 2 permits up to 20 hours weekly in term and 40 hours during June–September and 15 December–15 January. Add every employer; this is a weekly limit, not a monthly average. Stamp 2A permits no work.

From 1 January 2026 the National Minimum Wage is €14.15/hour from age 20, €12.74 at 19, €11.32 at 18 and €9.91 under 18. Higher sectoral rates may apply. Only the official board/lodging allowances can count toward minimum wage: meals €1.27 per hour and accommodation €33.42 per week (€4.77 per day).

Core terms are due within five days and the full written statement within one month. Ordinary minimum breaks are 15 minutes after more than 4.5 hours and 30 minutes after more than 6 hours, including the first break; they need not be paid. The ordinary 48-hour average maximum does not replace the lower Stamp 2 limit. Keep rosters, clock records, payslips and bank credits; WRC claim deadlines can be short.

Personal payroll audit

Each pay cycle compares rosters, hours started/finished, breaks, classification, base rate, increases, allowances, deductions and net received. Record mandatory training, opening/closing and work requested out of shift separately. Don’t wait months: small repeated errors become difficult to reconstruct and some actions have short deadlines.

Keep evidence in a personal account, not just in the employer’s app. Download agreement, payslip and roster; Photograph timesheets if permitted and save messages about changes. Don’t bring customer data or company secrets: document your relationship without violating other people’s privacy.

Evaluate an offer

Before accepting, ask for the company’s legal name/number, location, duties, employment status, guaranteed hours, rate, pay cycle, proof, notice and responsible person. Compare travel costs and times with study and visa. A seemingly high contractor salary may be lower after tax, insurance, leave and non-billable time.

Refuse payments to obtain shifts, mandatory purchase of sponsorship, refund of cash and withheld documents. Do not sign blank sheets or fake timesheets. If housing and work depend on the same person, prepare an alternative plan: losing both increases the power of blackmail.

Proportionate escalation

For a simple error, send calculation and request with a reasonable deadline. For lack of salary, security, discrimination or migratory threat, immediately use the competent body, union, community legal service or student support. In an emergency, protect the person before the tests. Don’t accept a settlement or resignation without understanding waivers, taxes and visa consequences.
