Information guide for international students, not individual legal, tax or medical advice. The rules depend on citizenship, course and visa conditions: before paying or submitting an application, always check the updated text of the indicated authority.
First rule: the law depends on the State
Residential tenancies, bonds, increases, inspections and notices are not uniform across Australia. Find your property regulator now: NSW Fair Trading, Consumer Affairs Victoria, Residential Tenancies Authority Queensland, Consumer Protection WA, CBS South Australia, Access Canberra, Consumer Affairs and Fair Trading Tasmania or NT Consumer Affairs. A national page can provide guidance, but the valid form is the local one.
Choose the formula
Managed student accommodation offers clear contracts and services but often costs more. Homestay can include meals and house rules. In private rental you are tenants with formal rights and obligations. In a share house you have to understand whether you sign the lease, are an authorized sub-tenant or an occupier/boarder: the protection changes. Always ask who holds the bond, who can authorize the sublet, and how the early exit is divided.
Application and anti-scam control
Prepare identity, CoE/proof of education, funds or guarantor and references without sending more data than necessary. Visit the property in person or on verifiable video, look up the address and check the agent’s identity/license. Don’t pay to “lock” a room seen only on social media, don’t use crypto or gift cards and don’t accept keys sent from abroad. Read amount, duration, break fee, inclusions and guest rules before paying.
Entrance: bond and condition report
Demand receipt and confirmation that the bond is deposited according to state procedure, not simply held in a private account. Complete the condition report on time: photograph walls, floors, appliances, counters and dated keys, report mold, leaks and non-functioning devices. Save ad and inventory: These are proofs of the promised state.
During and at the end
Pay with a traceable method and keep ledger/receipts. Urgent repairs follow local procedures: notify in writing and use the correct channel before anticipating costs. The owner cannot enter freely, but notices and permitted reasons vary. To exit, send the correct notice, agree to final inspection, return keys and submit the bond request. In share houses it also documents the internal distribution, because the authority may not resolve disputes between roommates.

Calculate the real cost of a room
Compare weekly and non-monthly cost: to estimate the month use weekly rent × 52 ÷ 12. Add electricity, gas, water when chargeable, internet, laundry, transport and furniture. Ask if the price increases during the year and if there are legal fees. Remote accommodation may cost less but require two passes and taxis after evening shifts. Don’t commit more than your sustainable budget by counting on future working hours.
Lease, co-tenancy and joint liability
Read who is listed as a residential rental provider/landlord, agent and renter/tenant. In co-tenancy each signatory may be liable for the entire debt or damages, even if you have divided the shares between joint tenants. The replacement of a roommate must be formalized and the bond updated. Anyone who leaves the contract without removal may remain exposed; those who enter by paying the previous occupant without consent may not obtain the rights imagined.
Privacy in the application
Agents often ask for many documents. Provide only what is necessary, obscure irrelevant bank numbers and use verified portals. Ask how the data will be stored. Do not send passport and bank statements to social profiles. If they ask you for payments before the visit, verify your license and office through the state registry.
Minimum standards, mold and repairs
Minimum standards vary: locks, heating, ventilation, smoke alarms and electrical safety do not have a single national rule. Document mold and moisture on the first day. Ventilation does not solve leaks or failures. Report in writing with photo, available access and specific request. For urgent repairs use the State’s definition and contact details; you do not unilaterally withhold rent without advice.
Inspections and quiet enjoyment
The owner may enter only for permitted reasons and with required notice, except in emergencies. Keep notice and ask for reasonable rescheduling when necessary. You must allow legitimate access, but you have the right to quiet enjoyment. Internal cameras, unannounced visits or repeated pressures should be documented and brought to the regulator.
Utilities and consumption
Read the meters at the entrance and exit. Check if the user is separately metered: it affects what you can be charged. In share house agree formula, date of bills and management of those who leave. Do not register all utilities without a refund agreement. Check concessions and hardship support, but do not assume eligibility as an international student.
Early termination and break lease
Fixed term does not mean it is impossible to leave, but there may be legitimate costs up to relocation or regulated fees. The landlord must normally mitigate the loss. Ask for the written calculation, advertisement and date of the new tenant. Family violence, uninhabitable property or other reasons may have special procedures: use the state channel and protect address and security.
Bond: procedure and evidence
Do not authorize a general “cleaning” withholding. Compare initial and final condition reports, wear and tear and damage. Request invoices or quotes. Submit the bond claim through the relevant authority and comply with the deadlines for contesting. An automatic professional cleaning is not always taxable: it depends on the contract, the state and the actual conditions.
Student accommodation and homestay
Managed housing may fall under rules other than the standard residential tenancy. Read cancellation, relocation, conduct, overnight guests, meal plans and campus closures. For homestay clarify meals, transportation, curfew, laundry and procedure if the relationship fails. Under 18 years of age, all travel must respect welfare arrangements.
Escalation of the dispute
Write a timeline with amounts, dates, photographs and requests. Send clear communication first; then formal notice if required. Use tenancy advice service or student legal service before the court. NSW uses NCAT, Victoria VCAT and the other states have their own bodies. Don’t skip a hearing or assume that leaving the country will erase the debt.
Practical case manual
These scenarios do not replace an individual assessment: they serve to recognize the problem, stop the risky action and identify the next control.
- Case 1— The ad says bills included: list which utilities, any fair-use cap and adjustment method; an advertising phrase does not explain exceptional increases or consumption.
- Case 2— You pay bonds to the main tenant: ask for subletting authorization, receipt and return path. Check to see if the relationship is covered by state law.
- Case 3— The condition report is already marked clean: correct it with photographs and send it within the deadline. Silence can be used to argue that the defect arose later.
- Case 4— Mold appears after rain: photograph, measure if possible, report infiltration and ask for intervention. Continue reasonable ventilation without automatically accepting blame.
- Case 5— A repair is urgent: use the number and official definition of the State, document attempts and before advancing money check the expected limit and reimbursement.
- Case 6— The agent wants to carry out frequent open inspections: check notices and frequency of admissions, propose times and maintain access. Quiet enjoyment continues until the end.
- Case 7— A roommate doesn’t pay: the landlord can take action against the other signatories. Document internal debt and seek replacement only with formal consent.
- Case 8— You want to transfer the lease: ask for a trial, legal fees, new application and bond transfer. Don’t just hand over keys and passwords to the new occupant.
- Case 9— The rent increases: check form, notice, frequency and right of challenge in the State. Continue to pay the amount due while you properly dispute.
- Case 10— The property is sold: tenancy does not necessarily end immediately. Read notice, access for photographs and sale according to jurisdiction.
- Case 11— Lose the keys: inform immediately and agree on the documented cost. Do not change locks without authorization unless applicable security procedure.
- Case 12— Experience domestic violence: Each state offers special mechanisms for exit, safety and accountability. Contact specialist service before revealing new position.
- Case 13— The agent demands carpet steam cleaning: verify contract, law and actual condition. Ask for written basis and do not accept automatic deduction.
- Case 14— The bond is not deposited: keep proof of payment and contact bond authorities. Don’t wait for the exit, when recovering facts and identities is more difficult.
- Case 15— Receive termination notice: check reason, form, date and possibility of dispute. A notice does not authorize the landlord to change locks immediately.
Due diligence before handing over money
Do a three-level check: person, property and contract. For the person, confirm agent or owner through registry, office or consistent documents; do not just use the number provided in the advert. For the property, compare address, visit, photographs and actual availability. For the contract, identify applicable law, parties, duration, rent, bond, utilities, exit and repair procedure. If one of the three levels doesn’t add up, don’t pay to “don’t miss out”.
Use traceable payments with reason and keep receipt. A bank transfer does not in itself prove that it was a bond, rent or fee: the reason and the agreement make it clear. Do not hand over cash without a receipt and do not use crypto, gift cards or transfers in a foreign name. Protect your passport and bank statement: a real estate scam can also become identity theft.
Tenancy diary
Maintain a timeline from announcement to bond repayment. Archive agreements, condition reports, original photographs, receipts, notices, repair requests and responses. By phone, he then sends an email: “I confirm today’s conversation…”. Photograph the damage in context and in detail, without changing metadata. Record when you allowed access and what was done.
If a dispute arises, separate facts from conclusions. Write the date, obligation, proof, consequence and remedy requested. Avoid insults or threats to stop paying. Use the local form and ask for support before a deadline. Continuing to meet undisputed obligations strengthens your position.
Exit checklist
Calculate notice and delivery date; agree inspection; photograph every room, meters and keys; close or transfer utilities; communicate forwarding address when appropriate. Ask for a final rent ledger and start the official bond procedure. Keep evidence after the transfer and don’t assume that silence closes the case: check the claims and terms of the tribunal.
