Information guide for international students, not individual legal, tax or medical advice. The rules depend on citizenship, course and visa conditions: before paying or submitting an application, always check the updated text of the indicated authority.
First comes the visa condition
Check VEVO and the grant letter before the first round. For many student visa holders the limit during course periods is48 hours for fortnight; Different conditions may apply during official breaks. Don’t make the rule “24 hours every week”: Fortnight is the period defined by immigration. Postgraduate research, family and old grants may have different conditions. Work must not compromise enrollment and progression.
Contract, award and pay
In Australia “casual” does not mean work without rights: it normally involves casual loading because some guarantees of permanent part-time are missing. Correct pay often comes from amodern award, classification, age and increases for evenings, weekends or holidays, not just the National Minimum Wage. Use Fair Work’s Pay and Conditions Tool and ask for role, classification, rate, super fund and shift arrangements in writing.
Every turn must leave a trace
Record hours, breaks and roster messages. The employer must provide pay slip within the established deadlines; compare hours, rate, loading, penalty rates, tax and super. Cash payments do not eliminate rights. These are warning signs: long and free production “trial”, repayment of part of the salary, ABN imposed for normal employed work, salary under award or threat of immigration notification.
Placement and unpaid work
A vocational placement can only be unpaid if it falls within the legal requirements and the authorized path. An internship called an “internship” does not automatically become free: if you carry out useful work as an employee, ask the university and Fair Work for an evaluation. The hours worked and visa conditions must also be checked for some training activities.
If there is exploitation
Keep contract, roster, pay slips, statements and chats on a personal account. Fair Work also offers information to migrant workers and rights at work do not disappear due to visa status. For immediate danger call 000; for wage theft or dismissal act quickly because some claims have short deadlines. Don’t sign a “waiver” without understanding it.

Fortnight, breaks and recording of hours
For the ordinary condition, the fortnight is a 14-day period starting on Monday. Plan shifts over the entire period, do not compensate for excess hours with the following week. Ask the provider which dates are scheduled course breaks: a personal break, a week without classes or the time after finishing exams are not automatically official holidays. Maintain academic calendar and roster.
Awards and classification
Identify industry awards and levels based on actual tasks. Hospitality, retail, clerical and social/community services have different structures. Check base rate, casual loading, overtime, penalty, allowances and minimum engagement. The title “all-rounder” does not replace classification. Fair Work PACT allows a calculation, but enter the correct age, status and hours.
Casual, part-time and fixed term
The casual does not have a firm, continuous advance commitment and receives loading, while part-time has agreed hours and some paid leaves. Reality can evolve and in some cases there is a path towards permanent employment. A fixed-term contract has its own limitations and disclosures. Super, tax and onboarding
Provide TFN declaration and super choice through secure channels. Check the super fund in myGov/ATO and do not accept that the loading “includes” mandatory contributions. Don’t pay a middleman to get TFN. The employer cannot withhold passport or ask for money for sponsorship or shifts.
Security and discrimination
You have the right to training, devices and a safe environment. Report incidents and consult your state’s Safe Work regulator. Discrimination, harassment and adverse action may involve the Fair Work Commission or human rights bodies. The terms for unfair dismissal/general protections are short: ask for help now.
Resignation and dismissal
Check notice in the award or agreement. Ask for final pay with wages, leave due and other amounts. Do not sign backdated resignations. If the employer fires you because you asked for correct pay, document the connection. Returning uniform or keys does not authorize arbitrary deductions.
Practical case manual
These scenarios do not replace an individual assessment: they serve to recognize the problem, stop the risky action and identify the next control.
- Case 1— Two employers assign you hours: add everything in the fortnight and communicate compatible availability. Each employer only sees their own roster, but the migration responsibility remains yours.
- Case 2— The venue offers an unpaid trial of four productive hours: ask for duration and tasks; a short demonstration is different from covering a shift.
- Case 3— Receive cash without payslip: write down hours and ask for identification. Cash is only legal if salary, tax, super and records remain correct.
- Case 4— They classify you as a contractor: compare control, uniform, customers and risk. An ABN does not automatically convert an employee into an independent business.
- Case 5— The roster changes at the last minute: check award, agreement and casual status. Keep messages and do not accept punitive deductions for unavailability not agreed upon.
- Case 6— Work at night or on holidays: check penalty rates and minimum engagement in your award. The weekday rate is not enough as a comparison.
- Case 7— Boss holds passport: ask for return and contact support; it is not a legitimate guarantee for uniform, housing or shifts.
- Case 8— Pay is under award: calculate period and difference with PACT, submit written request and maintain evidence before company accounts are closed.
- Case 9— Suffer an injury: seek treatment, report and record workers compensation according to the State. Fear of a visa should not prevent reporting.
- Case 10— You get fired after a complaint: note sequence and ask for immediate help; Fair Work Commission applications have very short deadlines.
Personal payroll audit
Each pay cycle compares rosters, hours started/finished, breaks, classification, base rate, increases, allowances, deductions and net received. Record mandatory training, opening/closing and work requested out of shift separately. Don’t wait months: small repeated errors become difficult to reconstruct and some actions have short deadlines.
Keep evidence in a personal account, not just in the employer’s app. Download agreement, payslip and roster; Photograph timesheets if permitted and save messages about changes. Don’t bring customer data or company secrets: document your relationship without violating other people’s privacy.
Evaluate an offer
Before accepting, ask for the company’s legal name/number, location, duties, employment status, guaranteed hours, rate, pay cycle, proof, notice and responsible person. Compare travel costs and times with study and visa. A seemingly high contractor salary may be lower after tax, insurance, leave and non-billable time.
Refuse payments to obtain shifts, mandatory purchase of sponsorship, refund of cash and withheld documents. Do not sign blank sheets or fake timesheets. If housing and work depend on the same person, prepare an alternative plan: losing both increases the power of blackmail.
Proportionate escalation
For a simple error, send calculation and request with a reasonable deadline. For lack of salary, security, discrimination or migratory threat, immediately use the competent body, union, community legal service or student support. In an emergency, protect the person before the tests. Don’t accept a settlement or resignation without understanding waivers, taxes and visa consequences.
